ON FEBRUARY 17, 2012 a Ramapo Town Justice dismissed the Petition in a landlord -tenant dispute based on Respondent/Tenant's motion pursuant to RPAPL (Real Property Actions and Procedures Law) §232(b). That section requires a landlord to provide a 30 notice of termination to a holdover tenant without a lease. Representing the Respondent/Tenant, David M. Ascher, an associate with Barr, Post & Associates, successfully argued that because the lease between the parties expired November 30, 2011, and the Petition for Eviction was dated December 1, 2011, any rights the landlord had under the lease had expired and strict compliance with the RPAPL was required. Mr. Ascher has several years of experience handling landlord/tenant disputes, representing both landlords and tenants. Along with the representation of all parties in landlord/tenant disputes, the firm also represents both tenants and landlords in commercial and residential lease negotiation and litigation.
